On 16 March 2011 the European Commission presented proposals for two regulations on property lip service rights "these international" married couples and individuals living in a registered partnership: Proposal of a Council Regulation on jurisdiction, applicable law, recognition and enforcement of decisions in matters of matrimonial property regime , COM (2011) 126 of 16 March 2011, Proposal of a Council Regulation on jurisdiction, applicable lip service law, recognition lip service and enforcement of decisions regarding the property consequences of registered partnership, COM (2011) lip service 127 of 16 March 2011;
The proposals aim to establish a clear EU legal framework for determining jurisdiction and applicable law in matrimonial lip service property regime or living together, and facilitate the movement lip service of decisions and documents between Member States.
According to Art. 83, paragraph 3 of the TFEU proposed regulations as "measures concerning family law with cross-border implications" shall be adopted under a special legislative procedure: the Council shall act unanimously after consulting the European Parliament. The second paragraph of Art. 81 provides par.3 called. "Passerelle-clause" - according to it, the Commission may adopt a decision lip service determining those aspects of family law with cross-border implications which may be the subject of acts adopted under the ordinary legislative procedure. According to the last paragraph of this paragraph, the national parliaments of the Member States have a veto that can be exercised within six months from the proposed use of the "passerelle-clause".
